Ashley St. Clair Sues ex Elon Musk for Sole Legal Custody of Their Son, His 13th Child, Submitting Texts to Court as Evidence

Ashley St. Clair, author and mother of one of Elon Musk’s 13 children, filed a lawsuit against him seeking sole custody of their son. St. Clair, 26, recently filed her custody petition in Manhattan with the New York Supreme Court for New York County, where the plaintiff and her child are residents.

St. Clair also filed a separate paternity petition for the child, born in September 2024.

In court documents, St. Clair said that Musk was not present at the birth of their child, whose name is listed as R.S.C., and has only met his son a few times between September and November of 2024. She also alleges he has “no involvement in his care and upbringing."

St. Clair alleges in the complaint that she met Musk in 2023, and they had a "romantic relationship in or about May 2023," and after having intercourse with Musk in January 2024, she became pregnant with her son, who was born nine months later.

In the petition, St. Clair claims Musk acknowledged his “parentage of the child in various written correspondences” including text messages. In one such exchange, St. Clair alleges she sent a picture of herself with the baby to Musk, who replied with, "I look forward to seeing you and him this weekend.” She submitted alleged evidence to the court of Musk acknowledging his being the father of Ms. Clair’s son in the form of screenshots of alleged conversations with the billionaire.

Text messages also reveal another indication of Musk admitting paternity in a discussion related to Musk traveling to visit the child. According to a text submitted with court papers, Musk wrote, “If I make a mistake on security, [R.S.C.] will never know his father."

St. Clair also claims in court documents that Musk texted her, “I want to knock you up again” on November 24, 2024. In January 2024 St. Clair alleges he also texted her, “Well, we do have a legion of kids to make.”

The plaintiff also submitted a photo as evidence to the court, of Musk holding an infant.

Ashey St. Clair is known for her support of conservative issues and as the author of the popular children’s book, ‘Elephants are not Birds.’ This is her second child.

Musk is also the father of Nevada, Vivian, Griffin, Kai, Saxon, Damian, X Æ A-12, Exa, Strider, Azure, Techno, and his second youngest child whose name has not been made public.

St. Clair asked the court to order Musk to take a paternity test, as per her paternity petition.
