EX-Fox Anchor Ed Henry Sues CNN, NPR, Fox for Defamation
Former Fox News anchor Ed Henry has filed several lawsuits alleging defamation against reporters and his former employer, Fox News. His lawsuit against the Fox News Network seeks punitive damages as he claims the outlet’s top executives defamed him following allegations of sexual misconduct.
Henry was fired from the network after allegations of sexual misconduct were brought forth against him last year. In an email to employees at Fox, CEO Suzanne Scott and President Jay Wallace wrote that Henry was involved in “sexual misconduct in the workplace.” Following a suspension from his on-air duties, Henry was fired as the result of a third-party investigation.
In his lawsuit, Henry contends that Scott and other executives operated as hypocrites in an attempt to smear his name. Additionally, Henry accuses Scott of trying to cover up sexual misconduct that is occurring in the network's senior management.
The lawsuit contends, “Scott had long been an instrument to cover up the existence of sexual misconduct at Fox News.” He adds that Scott gave "credence to the false allegations because she was trying to save her own career and burnish her image as a tough, no nonsense female executive who cleaned up Fox News."
Henry points to an inappropriate relationship that took place between the network President Jay Wallace and an employee under him as grounds for the cover-up that took place.
Fox has responded to Henry’s lawsuit and explains, “As we stated one year ago, Fox News Media conducted a thorough independent investigation into Ed Henry immediately after we were made aware of a serious misconduct claim against him by a former employee. Based on the results of those findings, we promptly terminated Mr. Henry’s employment for willful sexual misconduct and stand by the decision entirely.”
Fox has shared that Henry “further embarrasses himself in a lawsuit rife with inaccuracies after driving his personal life into the ground with countless extramarital affairs in a desperate attempt for relevance and redemption."
Henry Targets CNN and NPR Reporters
In a separate complaint, Henry has filed for actual and punitive damages from CNN correspondents Alisyn Camerota and Brian Stelter and NPR correspondent David Folkenflik. In this complaint, Henry alleges that the reporters acted with “malice” in the manner by which they reported on Henry’s sexual misconduct allegations. Henry alleges that they "intentionally or recklessly” made “false statements." Henry points to a tweet made by Folkenflik which reads, “Back in 2017, Fox's top news exec and & top HR official were warned that giving Henry hosting roles would damage reform efforts after harassment scandals there.” Folkenflik attached an NPR article covering the topic.
In regards to the CNN correspondents, Henry points to an on-air conversation the two had regarding Henry’s departure from Fox. His lawsuit states that the conversation "recklessly republished Mr. Folkenflik’s allegation without confirming its authenticity."
Along with Fox, NPR’s Isabel Lara, the executive director of communications, responded to Henry’s Lawsuit stating, "NPR stands behind David Folkenflik’s reporting and will vigorously defend it against this meritless claim.” Lara adds, "Millions of Americans trust NPR to provide accurate information about the world and their communities every day; we take this responsibility very seriously."
In a statement shared with USA Today, Henry’s lawyer Ty Clevenger explains that Henry “reluctantly” pushed forward with the lawsuits because he is a “journalist’s journalist” and that the reporters and news networks that defamed him "will be held accountable for what they've done."
