Family of Beaten Texas Teen Files $50 million Lawsuit Against Classmates and Parents

The family of a Texas teen who was brutally attacked by his classmates is suing those classmates and their parents in a $50 million lawsuit.

Sixteen-year-old football star Cole Hagan was brutally attacked at a house party in Lake Jackson, Texas, during the late evening hours of December 3rd last year. Following the brutal attack, he was left unconscious, bleeding from his ears, and spent the next several weeks on a ventilator in the ICU. His family shares that because of his injuries, he is unlikely to ever play college football. Hagan was able to eventually come off of the ventilator and begin breathing on his own again.

Authorities quickly arrested three of his classmates in connection to the beating. Seventeen-year-old Reid Mitchell allegedly punched Hagan in the face and then slammed him onto the concrete floor according to witnesses. Two other classmates, 17-year-old Ayden Holland and 18-year-old Logan Huber also joined in on the assault. All three have been charged with aggravated assault. Hagan's older brother, Cory Hagan, shared with local news outlet KTRK, "They left him in the road after they finished attacking him and then texted one of his friends that were in the backyard of this house to say, 'Hey come get your boy out of the street.' They left him in the street, people who were supposed to be his friends."

As the teen continues his recovery, the Hagan family has moved forward with a lawsuit that names 16 people including teens who were at the party and at least nine parents. The family's attorney Loren Klitsas shared with Insider, "The Hagan family is going to pursue justice in this case. Their son Cole, a star football player, is permanently damaged, and they have no choice but to pursue the parties that are responsible for it. It's horrible."

The lawsuit alleges that Hagan's peers and their parents “knew or should have known of the plan to attack Cole Hagan,” in addition to making “false and defamatory statements” about the teen in an effort to harm his reputation at the school. The suit also alleges that other students know about the threat of bodily harm to Hagan but did nothing to stop it. The complaint details that photos of Hagan were circulated among his peers, including Mitchell, and the photos showed intent for the brutal attack to happen.

The three boys who have been charged with aggravated assault gave initial statements to police about the attack but then later changed their statements detailing that they attacked Hagan because of remarks he made toward a female friend of theirs. Despite this, there is no evidence to show that the teens’ claims are true.

Scott Brown, the attorney representing Huber, shared that his client would fight back against the claims made in the lawsuit. "We believe that, unfortunately, he was just an innocent pawn in all of this with no knowledge of exactly what was going to happen, the way that it happened," Brown shared.

The family is seeking an excess of $50 million in damages as a result of the attack on their son.
