FL Daycare at the Center of New Lawsuit After Child Suffers Injuries and Concussion

A Jacksonville, Florida, family has filed a lawsuit against their child's daycare facility after they say their child was left injured with a black eye, busted lip, and concussion.

The mother who filed the lawsuit has not been publicly named, but reports detail that she is suing the child care facility, Kid Kingdom, and seeking at least $30,000 in damages after her son allegedly sustained injuries while under the supervision of the daycare.

The family is represented by Sara Foster, an attorney with Morgan & Morgan based in Orlando. During an interview with local outlet Action News Jax, Foster explained that the daycare was negligent for failing to properly care for the children at the facility by providing inadequate observation and supervision of children. Foster details that this negligence enabled her client's toddler to get injured while at the facility.

Foster has also detailed that she's been in contact with other former employees at the daycare who have come forward with allegations that staff members were known to drink alcohol while on the job. Along with other concerned community members, Foster anticipates that there could be additional victims who have not yet come forward.

Local resident Ty Smothers shared with Action News Jax that she had similar concerns about safety at the facility. These concerns prompted her to take her child out of the daycare. Smothers shared, “I am full of emotions. Because as a parent, you send your child to be protected by these people that you leave them with so early in the morning because you have to go to work.”

Outlined in the lawsuit are allegations that the childcare facility at times resorted to using under-aged employees to take care of infants and young toddlers. These under-age employees are described as not having been adequately trained or certified to take care of such young children.

According to an investigation conducted by the local outlet, the daycare facility has had at least six violations related to the claims made against them in this recent lawsuit. In October 2021, the facility was in violation of state guidelines for not having a proper staff-to-child ratio as detailed by a state inspector.

In January 2022, the facility was again flagged for not having proper documentation that showed staff were given the required introductory training in the first 90 days of their employment.

According to the Department of Children and Families, in April 2022, the facility yet again violated guidelines after it failed to share an accident form with a parent.

Foster shared, “I’m a mom just like my client and I drop my kids off at daycare so that I can provide for my family — and I know she did the same. So it’s extremely concerning.” Adding, “Anytime a child comes home from daycare and needs to go immediately to the hospital for an injury — especially head injury, is a big concern.”

In addition to operating negligently, the lawsuit is seeking to hold the childcare facility accountable for its inadequate care of children. It's not yet clear what that accountability could look like.
