Hutchins Wrongful Death Lawsuit Against Alec Baldwin and Others Ends in Settlement

The family of Halyna Hutchins, the cinematographer killed while on the set of the movie Rust, has settled their wrongful death lawsuit against Alec Baldwin and the other producers of that movie.

In a statement released last Wednesday, Halyna’s widower, Matthew Hutchins, shared a statement that read in part, “We have reached a settlement, subject to court approval, for our wrongful death case against the producers of Rust including Alec Baldwin.” His statement adds, “As part of that settlement, our case will be dismissed. The filming of Rust, which I will now executive produce, will resume with all the original principal players on board, in January 2023.”

The settlement is a glimmer of hope for Alec Baldwin who has been at the center of lawsuits, criminal investigations, and national scrutiny after the gun he was holding fired a live round while on set last October. The live round struck Hutchins, killing her on impact before fragments ricocheted and injured assistant director Joel Souza.

News of the settlement came last week after Baldwin shared an Instagram post that explained, “Throughout this difficult process, everyone has maintained the specific desire to do what is best for Halyna’s son.” Baldwin added, “We are grateful to everyone who contributed to the resolution of this tragic and painful situation.”

Much of the details surrounding the settlement, including any financial compensation to the Hutchins family, has not been publicly released. However, Matthew Hutchins has shared that he has “no interest in engaging in recriminations or attribution of blame.” His statement added that “All of us believe Halyna’s death was a terrible accident. I am grateful that the producers and the entertainment community have come together to pay tribute to Halyna’s final work.”

The settlement and the comments made by Hutchins’ husband have come somewhat as a surprise to many. Following the fatal shooting last year, Hutchins was quick to call out Baldwin and his lack of accountability after fatally shooting his wife. In an interview with Today's Hoda Kotb in February, Hutchins blamed Alec Baldwin for his wife's death and "industry standards that were not practiced" on set.

At one point during the interview, Hutchins shared, "The idea that the person holding the gun and causing it to discharge is not responsible is absurd to me." He later added, "Almost sounds like he was the victim. And hearing him blame Halyna in the interview and shift responsibility to others and seeing him cry about it. I just feel — are we really supposed to feel bad about you, Mr. Baldwin?"

While the wrongful death lawsuit against Baldwin and the producers of the film has been settled, there are at least four other lawsuits brought forward by crew members that are still pending. Additionally, the state of New Mexico is still investigating whether or not criminal charges will be brought against Baldwin or others.

Following news of the settlement, the office of New Mexico’s First Judicial District Attorney Mary Carmack-Altwies shared in a statement that the settlement does not absolve Baldwin or others from criminal charges related to Halyna Hutchins’ death. "If the facts and evidence warrant criminal charges under New Mexico law then charges will be brought. No one is above the law," a spokesperson for Carmack-Altwies’ office shared.

The statement came just days after her office filed an emergency request asking the state for extra funding in order to pursue possible criminal charges against at least four individuals involved. Despite having asked for $635,000, her office was awarded $317,000 to continue with the investigation.
