Judge Denies Lizzo's Dismissal Request in Sexual Harassment Lawsuit

The denial of Lizzo's request to dismiss the lawsuit filed by three of her former dancers marks the latest development in the pop star’s ongoing legal battle. Judge Mark H. Epstein's ruling, detailed in a 34-page decision in Los Angeles County Superior Court, highlighted the complexities surrounding Lizzo's argument for dismissal under the anti-SLAPP statute. The anti-SLAPP statute, known as Strategic Lawsuits Against Public Participation, aims to protect defendants' rights to free speech under the First Amendment.

As reported by Billboard, while parts of Lizzo's argument aligned with the anti-SLAPP statute, Judge Epstein opted to dismiss certain accusations against Lizzo and her team, including allegations of fat-shaming one of the dancers. However, he also noted that Lizzo's requirement for dancers to participate in a nude photoshoot for her show "Watch Out for the Big Grrrls" was protected under anti-SLAPP law as part of the "creative process," falling within the realm of protected free speech.

Judge Epstein emphasized the importance of balancing free speech rights with considerations of alleged misconduct and discrimination. Furthermore, Epstein's ruling reflects the intricacies involved in adjudicating cases that intersect with constitutional rights, particularly in the context of the entertainment industry where creative expression and workplace dynamics converge.

Stefan Friedman, a spokesperson for Lizzo, shared with Entertainment Tonight gratitude for the dismissal of certain aspects of the lawsuit and emphasized Lizzo's commitment to positivity and empowerment. However, he indicated plans to appeal the elements of the lawsuit that the judge chose to uphold and expressed confidence in the future outcome of the case.
