Judge OK’s Boston Bomber’s Stimulus Payment to Go to Victims

A U.S. District Judge has granted a request made by federal prosecutors to claim funds in an inmate trust fund account controlled by accused Boston bomber, Dzhokhar Tsarnaev. According to the request, stimulus payments made to Tsarnaev will be collected and paid out to victims.

Massachusetts Acting U.S. Attorney Nathaniel R. Mendell filed the motion which details that Tsarnaev’s inmate account contains thousands of dollars and that the money should be recovered in order to pay back the victims and the families of those killed during the 2013 Boston Marathon bombing. Instead of making restitution, prosecutors allege that Tsarnaev has used the money to pay third parties including his family members.

The motion details, “The Defendant, although not making payments to his victims, has made payments to other third-parties.” The motion goes on to explain that Tsarnaev used some of his money to pay his siblings for items listed as “books,” “gifts,” and “support.”

“The United States submits that the requested relief is reasonable and appropriate in this instance, especially in light of the defendant prioritizing payments to his siblings over the victims of his crimes,” prosecutors explain.

In the court filings, prosecutors detail that Tsarnaev has only paid $2,202 of the $101.1 million he owes in criminal restitution and court fees. Court records detail that the money Tsarnaev did pay has gone to court fees and not victims and their families. As of late December, Tsarnaev’s account contained $3,885.

According to reports, since his incarceration, Tsarnaev has received over $21,000 in payments. Some of the money was deposited by the Office of Federal Defenders of New York. Between May 2016 and June 2021, the organization deposited $11,230 in Tsarnaev’s account. As per a federal court ruling last year which allowed qualifying inmates to receive stimulus funds under the CARES Act, Tsarnaev also received a $1,400 covid relief payment in June 2021.

At least 35 other sources are reported to have sent Tsarnaev money. Records indicate that Tsarnaev has regularly received money from individuals in New Jersey, Maryland, and Indiana.

Tsarnaev is currently serving a life sentence in a maximum-security facility in Florence, Colorado. Tsarnaev was originally sentenced to death, but the conviction was thrown out in July 2020 after Boston’s federal appeals court wrote that the judge did not do enough to ensure that he was tried in front of an unbiased jury. The Biden administration has since asked the Supreme Court to reinstate his death sentence. After hearing arguments in October, the Supreme Court has yet to issue a ruling.
