Nike Sues Custom Shoe Maker The Shoe Surgeon for Selling Counterfeit Products
Shoe customizer Dominic Ciambrone, popularly known online and by his customers as The Shoe Surgeon, is facing a $60 million lawsuit from global footwear giant Nike. The lawsuit alleges that Ciambrone is using Nike's trademarks, selling counterfeit products, and has usurped the Nike brand through his work of creating custom footwear using Nike shoes as the base.
Nike alleges in its complaint that The Shoe Surgeon attempted “to build an entire multifaceted retail empire” by using Nike’s trademark rights. This new lawsuit comes just weeks after Ciambrone was hit by a similar lawsuit from luxury leather retailer, Goyard. Nike filed its lawsuit earlier this week in the Southern District of New York.
Ciambrone operates the popular online retailer, The Shoe Surgeon. There, customers can place orders for bespoke shoes, designed to meet a customer's specific needs. Services for the custom shoes start at $5,000, and clients are required to provide the base shoe for recrafting as detailed on the website. In addition to the bespoke shoes, the company sells a range of custom-crafted shoes that display the Nike swoosh logo along with logos and materials that are identifiable as other brands. A number of the shoes boast iconic prints from Louis Vuitton, Gucci, and others, while the majority of the shoes are identifiably Nike and Addidas shoes that have been recrafted.
Nike's lawsuit names several shoes as being lifted directly from the popular shoe retailer and advertised on the shoe surgeon website. Among the silhouettes named in the lawsuit include the Nike Air Force 1, the Air Jordan 1, the Air Jordan 3, and the Air Jordan 4.
Nike says that it attempted on several occasions to remedy its complaints with Ciambrone directly without going through the legal system. While Ciambrone removed the alleged infringed products from The Shoe Surgeon’s website, the products were posted for sale at a later date.
The lawsuit also names the brick-and-mortar Shoe Surgeon Academy which offers classes that teach customers how to customize Nike shoes.
The lawsuit is seeking damages for "over 30 Nike trademarks, totaling over $60 million dollars , or the profits the defendant generated from counterfeiting, trebled, along with attorneys’ fees."
Nike expressed that it doesn’t take issue with The Shoe Surgeon creating one-of-one custom sneakers for Nike athletes and other public figures. However, Nike wants to ensure “consumers are not misled and have access to authentic Nike, Inc. products that are authorized and created according to our high standards with the performance benefits they expect.”
