Texas Sues TikTok ‘Fit-Fluencer’ Over Misleading Weight Loss and Personalized Nutrition Plans

The state of Texas is suing a popular TikTok fitness influencer over claims that she misled her followers into purchasing her personalized weight loss programs only for them to be given generic plans instead. Some clients who battled health issues including eating disorders sought out personalized plans but were allegedly given weight loss plans instead.

The lawsuit was filed by Texas attorney general Ken Paxton against influencer Brittany Dawn Davis and her company, Brittany Dawn Fitness LLC. The lawsuit was filed on the 1st of this month in the Dallas County Court, and it comes roughly two years after complaints against the influencer first began to surface.

According to the Washington Post, Texas accuses the Fort Worth-based influencer of engaging in “deceptive acts.” The lawsuit claims that Davis perpetrated these acts by advertising to her hundreds of thousands of followers personalized nutrition guidance as well as individualized fitness coaching for those who purchased her weight loss plans. Davis advertised that the plans were personalized to meet a client's specific needs, though testimony from past clients in the suit detail that the plans were generic and not personalized. The state is also accusing Davis of selling those “personalized” plans to individuals who told her they suffered from specific conditions such as eating disorders.

Complaints against Davis first began to surface in 2019 after customers who purchased her plans began to complain about the lack of personalization and guidance promised. A Facebook group was later launched against the influencer called “Brittany Dawn Fitness Complaints.” The group grew to about 4,600 members by the end of February 2019. In the group, clients who purchased plans complained of receiving generic guidance from the influencer instead of personalized ones as promised.

Many of her clients also complained that they were getting a blanket nutrition plan despite their specific needs. The lawsuit highlights one client who reached out to Davis stating, “I truly need guidance, help, the right information, and support right now. I currently have an eating disorder, horrible body image views … I am underweight for my height.” Davis allegedly replied with a response that read, “Great! Welcome to the #teambrittanydawn family.” Many other clients came forward detailing that they sought out Davis because of her self-proclaimed efforts as an “eating disorder soldier.”

The lawsuit accuses the influencer of giving weight loss advice that was ultimately harmful. The complaint details another client who weighed roughly 200 lbs. After acting on the advice provided by Davis, the client claims that they passed out because they were not getting enough nutrition.

After the downfall in 2019, Davis shared an apology on her YouTube channel and later went on Good Morning America to defend her business practices. However, Davis explained that she was navigating an industry that had no written rules. She shared in her interview with Good Morning America, “I jumped into an industry that had no instruction manual.” Davis explained, “I’m basically going through uncharted territory, and I’m doing the best that I can to the best of my ability.”

In the lawsuit, the state is seeking to have Davis barred from selling her personalized exercise plans and nutrition guidance. The lawsuit is also seeking anywhere from $250,000 to $1 million in penalties and fees.

Davis has since rebranded herself and no longer markets herself as an exclusive fitness influencer. Instead, Davis has pivoted to being a Christianity influencer. As part of her social media marketing, Davis now sells Christianity-inspired retreats described as “a gospel-centered day with other God-fearing women.” Her retreat packages are offered at a cost of $125.
